This Policy covers personal information we process when you: Visit or use our website and any future client portal (the “Site”), Inquire about, purchase, or receive our services (online or offline), Communicate with us by email, phone, or otherwise, Participate in our classes, programs, or rentals.

2) What We Collect

We collect information you provide directly and information collected automatically.

Information you provide (examples): Identification & Contact: name, email, phone, mailing address; Demographic & Scheduling: due date, DOB, age range, gender, time zone, location, preferred providers; Service Details: preferences, class selections, support needs, notes needed to deliver services; Payment & Billing: we accept cash, check, or ACH. If ACH details are collected, they are processed via our payment provider or bank. We do not accept credit cards; Communications: emails, messages, inquiries, reviews/feedback (if enabled); Other data you choose to provide that is reasonably necessary to perform the Services.

Information we collect automatically (Site): Device and usage data such as IP address, browser type, pages viewed, time on page, and approximate location; Cookies and similar technologies for analytics and site functionality. See our Cookies Policy for details and choices.

Children’s data: Our Site is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe we have done so, contact us to delete it.

Sensitive health data: We do not collect or store Protected Health Information (PHI) on the Site. BYD does not provide medical services or advice. If PHI is ever needed, we will direct you to secure, dedicated channels described in our separate HIPAA notice (if adopted).

We use personal information to: Provide, schedule, and personalize Services (including doula, classes, virtual support, postpartum services, and rentals), Communicate about appointments, logistics, updates, and customer support, Process invoices/ACH payments, manage accounts and records, Send marketing emails (newsletters, updates, special offers) via our platform (currently GoHighLevel); you may opt out at any time, Operate, secure, troubleshoot, and improve the Site and Services (analytics, quality, training), Comply with law, enforce our Terms & Conditions, and protect our rights, users, and the public.

We do not sell or rent personal information.

4) Lawful Bases (EU/UK/Canada and similar jurisdictions)

Where required, we rely on one or more of the following lawful bases: to provide Services you request or to take steps at your request, for certain marketing or optional data uses; you can withdraw consent at any time, to operate and improve our Services, secure our systems, and communicate with you about similar offerings, to meet recordkeeping, tax, and compliance requirements.

5) Sharing & Disclosures

We share personal information only as described below: scheduling tools, email/CRM (GoHighLevel), analytics (see Cookies Policy), ACH/banking processors, cloud hosting, IT/security, and professional advisors (under confidentiality), limited access for doulas, instructors, and support personnel on a need-to-know basis to deliver Services, to comply with law, enforce our agreements, respond to lawful requests, or protect safety, rights, and property, in a merger, acquisition, or similar event, personal information may be transferred consistent with this Policy.

We do not allow vendors to use personal information for their own independent marketing without your consent.

6) International Transfers

We are based in the United States and process data there. If you access our Services from outside the U.S., your information will be transferred to the U.S. and other jurisdictions that may have different data protection laws. Where required, we implement appropriate safeguards for such transfers (e.g., contractual protections with processors).

7) Retention

We retain personal information for up to two (2) years from your last interaction unless you request deletion earlier, or a longer period is required by law (e.g., tax, accounting, compliance). We may retain minimal records (e.g., transaction logs, invoices) to meet legal obligations or to enforce our agreements.

We do not respond to Do Not Track signals at this time.

Our Site and Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have collected such information, contact us and we will delete it.

13) No PHI on the Site (HIPAA)

We do not collect or store Protected Health Information (PHI) on the Site. BYD does not provide medical services or advice. If PHI is required for a particular service in the future, we will use appropriate secure channels described in a separate HIPAA notice/policy.

14) Dispute Resolution & Governing Law

We aim to resolve privacy inquiries in good faith. If we cannot, privacy disputes are subject to mediation and then binding arbitration in Maryland (virtual proceedings permitted), consistent with our Terms & Conditions, and governed by Maryland law.

We may update this Policy from time to time. Changes take effect when posted with the “Last Updated” date above. Your continued use of the Services after changes means you accept the revised Policy.
